1. Definitions

- “Customer,” “you,” or “your” refers to the individual or entity using our services or purchasing our products.
- “Services” refers to the decoration and event planning services offered by Birthdaywala.in.
- “Products” refers to the items used in the decoration setups provided by Birthdaywala.in.
2. Booking and Payments
2.1 Advance Payment
- An advance payment of Rs. 500 is required to block the calendar date for your event.
- For theme parties or orders exceeding Rs. 5000, a 50% advance payment is necessary.
- The remaining amount must be settled in cash once our team reaches the venue. The payment structure is as follows:
- 20% at the time of material procurement.
- 30% at the time of delivery.
- No work will commence without receiving the remaining payment.
2.2 Customization
- Customization of items with others of similar cost is possible upon client request.
- Any additional items not mentioned in the package will incur extra charges.
2.3 Booking Timelines
- Packages must be booked at least 7 days prior to your preferred decoration time.
- For same-day bookings, confirmation is required at least 4 hours before the desired delivery time. Express delivery charges of Rs. 500 will apply if the booking is made with less than 4 hours’ notice.
- For same-day package bookings, please confirm availability by calling 9300630636 or WhatsApp before making the payment.
2.4 Postponement and Cancellation
- Cancellations must be communicated in writing.

In case of any circumstances where you want to cancel your pre-booked order, you can get a reimbursement of the deposit amount you have paid while booking the order, as per the below-mentioned reimbursement chart:
- If you cancel the order 7 days before the event date, a full refund will be issued.
- If you cancel the order between 7 to 5 days before the event day, a 50% refund will be issued.
- If you cancel the order less than 5 days before the event, no refund will be issued.
The given rate card is only for rental products. The refundable amount will be 100% for selling products.
- Postponements are subject to availability and may incur additional charges.
3. Setup and Requirements
3.1 Venue Preparation
- Client Must Arrange Sufficient space, continuous electric power, and a height stool or ladder for decoration must be arranged in advance.
- Client Must Ensure that adequate time is available to set up decorations at your venue. Minimum 2 Hrs Varying upon the decoration type.
3.2 Hire Basis
- All decoration items except balloons are provided on a hire basis. Extra charges apply if you wish to own them.
- Any damage to the merchandise during the event will be billed to the customer accordingly.
3.3 Permissions and Authorizations
- Customers must ensure that all necessary permissions, copyrights, and authorizations are in place to avail of our services.
- Our balloon expert will come to your selected place with your selected time slot and set up the balloons as shown in the images.
- We can decorate a hotel room if you Take permission from the hotel.
- we work seven days a week.
- You need to make sure that the decorator is allowed inside the society premises. If the decorator reaches the place and entry is denied to him, then it will be considered as delivery attempted and no refund will be given in this case.
4. Exclusions
4.1 Furniture and Fixtures
- The booking does not include any furniture or fixtures.
4.2 Cleaning and Housekeeping
- The booking does not include any cleaning or housekeeping services.
- Cleaning the area before and after decoration is not included in the package.Â
5. Liability and Safety
- Although we use all reasonable safety precautions, we cannot be held liable for any loss to your property or casualties arising at any stage.

Care Instructions
- Keep the Balloons away from Children, as uninflated or broken balloons can cause choking.
- Remove the cello tape immediately after the event is over. In case the cello tape is causing damage to the wall, use a hairdryer to blow hot air on the tape as it will prevent the damage.
6. Intellectual Property
- All content on Birthdaywala.in, including text, graphics, logos, images, and software, is the property of Birthdaywala.in and is protected by applicable copyright and trademark laws.
7. Privacy Policy
- Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
8. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Bhopal.
9. Changes to Terms and Conditions
- Birthdaywala.in reserves the right to revise these terms and conditions at any time without prior notice. By continuing to use our website and services, you agree to be bound by the updated terms.

11. Detailed Terms
11.1 General Terms
- Use of our website and services constitutes acceptance of these terms and conditions.
- Customers must be at least 18 years old to make a booking.
11.2 Payment Terms
- Advance payments are non-refundable but transferable for postponements.
- Full payment must be made prior to the commencement of services.
- Any additional costs incurred during the event will be billed to the customer and must be paid immediately.
11.3 Event Setup
- The customer must provide a safe and accessible environment for our team to work.
- Any delays caused by the customer may result in additional charges.
11.4 Decorations and Equipment
- All decorations and equipment are the property of Birthdaywala.in unless purchased by the customer.
- The customer is responsible for any loss or damage to our property during the event.

11.6 Liability
- Birthdaywala.in is not responsible for any injuries or damages that occur during the event.
- Customers are advised to have insurance coverage for their events.
11.7 Force Majeure
- Birthdaywala.in is not liable for any failure to perform due to unforeseen circumstances or events beyond our control.
11.8 Complaints and Disputes
- Any complaints must be reported immediately to our team on-site.
- Disputes will be resolved through arbitration in Bhopal.
11.9 Severability
- If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11.10 Entire Agreement
- These terms and conditions constitute the entire agreement between Birthdaywala.in and the customer and supersede all prior agreements and understandings.
12. Additional Terms
12.1 Delivery after 10 P.M.
- For delivery after 10 P.M., there will be an additional charge of Rs. 300.
12.2 Estimated Delivery Times
- The time slots available on the website are estimated delivery times. However, delivery can vary depending on various conditions.
12.3 Photograph Sharing where needed.
- Please share the photographs just after you make the booking on our email (anjalatms@gmail.com), with your name, date, time, and the package number you have booked.
- If you are unable to share the photos on time, an extra charge will be levied.
12.4 Delivery Time Preferences
- We try to deliver the product at your preferred time. However, the chosen delivery time is an estimate and depends on the availability of the product and the destination.
12.5 Location Map
- Please share your proper location map with our team.
- Our team will call you before leaving the office, so please be attentive to calls at the time and date of booking.
12.6 Decoration Requirements
- Sometimes decoration needs the sticking of tapes on the walls or roof. We are not responsible for any damage done by that.
- Your time preference will be taken for the decoration (between 07 am-11 pm), but it will be confirmed depending on slot availability.
- The setup will take around 2 hours to complete.
13. Copyright Terms
- We retain copyright to all our work images and may use a few images in our page/portfolio for the promotion of our work.
- We never use your images for commercial purposes/selling; it’s only used to demonstrate our previous works to new clients.
- If you don’t want your images displayed anywhere within our control, we charge a 30% higher photography fee from your total package amount.
